These Terms of Use (“Terms”) govern your access to and use of the Leasical website, products, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. What Leasical Is (and Isn’t)
Leasical is a platform for renters and property owners to share experiences and view information about property management companies. Leasical does not provide legal, financial, or real estate advice, and we do not guarantee the accuracy, completeness, or usefulness of user-submitted content.
2. Eligibility
You must be at least 18 years old (or the age of majority in your location) to create an account or submit content. By using the Services, you represent that you meet these requirements.
3. Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for activity that occurs under your account.
- We may suspend or terminate accounts that violate these Terms.
4. User Content (Reviews, Company Submissions, Comments)
You may be able to submit content such as reviews, ratings, company information, images, and other materials (“User Content”). You retain ownership of your User Content, but you grant Leasical a license to use it as described below.
4.1 Content Rules
Your User Content must:
- Be based on your genuine, first-hand experience when submitting reviews.
- Be truthful to the best of your knowledge and submitted in good faith.
- Not include private or sensitive personal information (e.g., SSNs, bank info, personal phone numbers, home addresses).
- Not include harassment, hate, threats, or discriminatory content.
- Not include false statements presented as fact or content intended to mislead.
- Not infringe on the rights of others (copyright, trademark, privacy, etc.).
- Not contain spam, advertising, or solicitations unrelated to the platform’s purpose.
4.2 Moderation and Enforcement
We may review, edit, remove, restrict visibility, or refuse to publish User Content at our discretion, including content that violates these Terms or our Review Guidelines. We may also take action on accounts involved in repeat violations.
4.3 License to Leasical
By submitting User Content, you grant Leasical a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting), publish, display, distribute, and create derivative works from your User Content in connection with operating, improving, and promoting the Services.
5. Company Responses
Companies may be able to respond publicly to reviews. A company response does not remove or alter the original review. We do not guarantee that a company will respond.
6. Intellectual Property
The Services, including the website design, logos, branding, and platform features, are owned by Leasical or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our written permission.
7. Prohibited Uses
You agree not to:
- Use the Services for unlawful purposes.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Scrape, harvest, or collect data from the Services without permission.
- Interfere with or disrupt the Services or servers.
- Impersonate others or misrepresent your affiliation.
8. Disclaimers
The Services and all content are provided “as is” and “as available.” To the fullest extent permitted by law, Leasical disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the fullest extent permitted by law, Leasical and its affiliates, owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services or reliance on content posted on the Services.
10. Indemnification
You agree to defend, indemnify, and hold harmless Leasical and its affiliates from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your User Content, or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Services at any time if we reasonably believe you violated these Terms or if necessary to protect the Services or other users. You may stop using the Services at any time.
12. Changes to These Terms
We may update these Terms from time to time. We will update the effective date when changes are made. Your continued use of the Services after changes means you accept the updated Terms.
